1. Acceptance of Terms
By accessing and using the website https://datapolis.cl (hereinafter, the "Site"), you agree to comply with and be bound by these Terms and Conditions of Use (hereinafter, the "Terms"). If you do not agree with any of their provisions, you must refrain from using the Site.
2. Object of the Service
Datapolis offers digital transformation consulting services, training in technology and Artificial Intelligence, and the development of personalized technological solutions. These services are primarily directed at small and medium-sized enterprises in Chile and may be subject to specific conditions, which will be regulated through individual contracts.
3. Use of the Site
The user is obliged to use the Site in accordance with the law, good faith, and public order. In particular, the following are prohibited:
- Using the Site for illegal or fraudulent purposes.
- Attempting to access systems, accounts, or data without authorization.
- Introducing viruses, malware, or any other harmful element.
- Violating the security measures of the Site.
- Reproducing, copying, or distributing content without authorization.
Datapolis reserves the right to suspend or block access in the event of non-compliance.
4. Intellectual Property
All content on the Site, including text, software, databases, designs, logos, images, and source code, is the property of Datapolis or its licensors and is protected by Chilean and international legislation on intellectual property. Any unauthorized reproduction, distribution, modification, or use is strictly prohibited.
5. Consumer Protection
5.1 Pre-contractual Information
Datapolis is committed to providing clear, truthful, and timely information regarding its services, prices, and conditions prior to contracting. If you have any questions before hiring, you may contact us through the channels indicated in Section 17 of this document.
5.2 Right of Withdrawal
In accordance with Law No. 19,496, the user may exercise the right of withdrawal within a period of 10 days from the date of contracting the service, except in those cases exempted by law, such as services already executed.
5.3 Warranties
The services provided are subject to current legal warranties. To make a warranty effective, we request that you contact us through the means indicated in Section 17 of this document.
6. Protection of Personal Data
6.1 Legal Framework
The processing of personal data is governed by Law No. 19,628 on the Protection of Private Life.
6.2 Collected Data
Datapolis may collect identification data (name, email, telephone), browsing data, and information necessary for the provision of services.
6.3 Purpose of Processing
The data will be used for the provision of contracted services, communication with the user, improvement of the Site, sending relevant information, and compliance with legal obligations.
6.4 Rights of the Holder
The user grants express consent for the processing of their data by using the Site. They may exercise their rights of access, rectification, cancellation, and opposition (ARCO) by contacting contacto@datapolis.cl.
7. Limitation of Liability
The Site and its contents are provided "as is" and "as available". Datapolis does not guarantee continuous availability, the absence of errors, or the absolute accuracy of the contents. In no event shall Datapolis be liable for direct or indirect damages, loss of data, loss of profits, service interruptions, or any other damage resulting from circumstances beyond the control of Datapolis.
8. Information Security
Datapolis adopts reasonable technical and organizational measures to protect user information. However, the user acknowledges that no system is completely secure.
9. Specific Responsibility for Artificial Intelligence (AI)
The user accepts that results generated by AI tools are statistical and probabilistic in nature; therefore, they may contain inaccuracies. It is the user's exclusive responsibility to review and validate any content or code generated by the AI before implementation. Datapolis utilizes models from external providers and is not responsible for biases or technical failures of such third parties.
10. Intellectual Property of Deliverables
All methodologies and pre-existing algorithms owned by Datapolis used for the service shall remain the exclusive property of the company. Unless otherwise agreed, the client acquires a perpetual and non-exclusive license to use the final deliverables generated for their project, and reselling them to third parties without express authorization is prohibited.
11. Confidentiality
Both parties are obliged to maintain strict confidentiality regarding sensitive information (trade secrets, business strategies, technical documentation) accessed during the provision of services. This confidentiality obligation shall persist for a period of 3 years after the termination of the contractual relationship.
12. Commercial Conditions and Payments
Service values shall be those established in the respective quote or contract. Failure to meet payment deadlines shall empower Datapolis to suspend the provision of services or access to platforms until the situation is regularized.
13. Cookies Policy
The Site uses cookies to improve functionality (maintaining sessions) and for anonymous statistical analysis of browsing traffic. The user may configure their browser to reject cookies, assuming that this could limit some functionalities of the Site.
14. Service Continuity and Force Majeure
Datapolis reserves the right to carry out scheduled interruptions for maintenance. Furthermore, it shall not be liable for non-compliance due to force majeure, such as natural disasters, massive internet infrastructure failures, external cyberattacks, or acts of authority.
15. Modifications to the Terms
Datapolis may modify these Terms at any time. Modifications will be published on the Site and will take effect upon publication. Continued use of the Site implies acceptance of such modifications.
16. Jurisdiction and Governing Law
These Terms shall be governed by the laws of the Republic of Chile. Any controversy shall be submitted to the jurisdiction of the ordinary courts of justice of the city of Santiago.
